Company: My Accessible Site LLC (“Company,” “we,” “our,” “us”)

Services: Accessibility tools, AI-based enhancements, monitoring, reports, and related support (“Services”).
By accessing or using our Services, you (“Client,” “you,” “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our Services.
1. No Guarantee of Full ADA, WCAG, or Legal Compliance
My Accessible Site LLC provides tools and services designed to enhance the accessibility of digital content. Client acknowledges that the Services utilize an "overlay" or "widget" technology combined with presentation-layer modifications.
My Accessible Site LLC does not guarantee full compliance with the Americans with Disabilities Act (ADA), Web Content Accessibility Guidelines (WCAG), Section 508, or any other federal, state, or local accessibility laws.
Client acknowledges and agrees that:
- The Services are an enhancement tool, not a replacement for fundamental source-code remediation.
- The Services do not "cure" all accessibility violations in the Client’s website code (e.g., PDF accessibility, video captioning, or complex backend coding errors).
- The Client remains the "Place of Public Accommodation" under the ADA and is solely responsible for their legal compliance strategy.
- Accessibility requirements evolve over time, and no automated tool can guarantee full legal immunity.
2. Not Legal Advice
Our Services, reports, statements, emails, or communications do not constitute legal advice. Clients should consult with qualified legal counsel regarding accessibility compliance obligations, risks, or legal strategy.
3. Client Responsibilities
Client agrees that:
- Client is solely responsible for the structure, design, content, and code of their website.
- Client must ensure their website’s underlying development practices meet accessibility guidelines.
- Client is responsible for granting access (temporary access, contributor roles, or copy/paste installation) required to install the Services.
- Backup Requirement: Client agrees to perform a full backup of their website prior to granting access to My Accessible Site LLC. Company is not responsible for data loss during installation or remediation.
- Client acknowledges that the Company cannot modify the Client’s website code directly unless explicitly contracted for separate paid services.
4. Limitation of Liability & Upstream Technology
A. General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY ACCESSIBLE SITE LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR REPUTATION.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS IS STRICTLY LIMITED TO THE AMOUNT PAID BY THE CLIENT IN THE ONE (1) MONTH PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
B. Specific Exclusions
We are explicitly not liable for:
- Any accessibility-related claims, ADA demand letters, or litigation filed against the Client.
- Errors, omissions, or failures in third-party tools.
- Service interruptions caused by Client’s website configuration, hosting, or CMS platform.
C. Upstream Provider
Client acknowledges that the Services rely on technology provided by third-party upstream providers. My Accessible Site LLC makes no representations regarding the uptime, accuracy, or continued availability of the Upstream Provider’s tools. We are not liable for failures, data breaches, or discontinuations of service caused by the Upstream Provider.
5. Third-Party Technology & Client Interference
Our Services rely on third-party accessibility tools, scripts, automation engines, APIs, and platforms. We are not responsible for outages, conflicts with website themes, or unintentional code interactions.
Client Interference: If Client installs new plugins, changes themes, or modifies code in a way that breaks the functionality of the Services, My Accessible Site LLC is not responsible. Re-integrating or fixing the Services after such changes will incur additional fees.
6. No Warranties
Services are provided “AS-IS” and without warranties of any kind, express or implied. This includes (but is not limited to) fitness for a particular purpose, merchantability, legal compliance, and uninterrupted or error-free functionality.
7. Payments & Renewals
- Services are billed monthly or annually via Stripe.
- All payments are non-refundable.
- Subscriptions automatically renew unless canceled.
- Client may cancel at any time via their account portal or by contacting support.
8. Termination
We may suspend or terminate access at any time for non-payment, abusive behavior, violation of these Terms, or unlawful use of Services.
9. Indemnification
Client agrees to indemnify, defend, and hold harmless My Accessible Site LLC from any claims, demands, actions, losses, liabilities, and expenses arising from:
- Client’s website content or design.
- Accessibility claims or lawsuits brought against the Client.
- Client’s misuse of the Services.
10. Governing Law
These Terms shall be governed by the laws of the State of Florida. Venue for disputes shall be Collier County, Florida.
11. Dispute Resolution, Arbitration, and Class Action Waiver
PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS.
A. Binding Arbitration: Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in Collier County, Florida, rather than in court.
B. Class Action Waiver: You and My Accessible Site LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
12. General Provisions
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Force Majeure: We are not liable for any failure to perform due to causes beyond our reasonable control (e.g., natural disasters, war, acts of terrorism, riots, power failure, or internet service provider failure).
Entire Agreement: These Terms constitute the entire agreement between you and My Accessible Site LLC regarding the Services.
13. Acceptance
By purchasing, installing, or using our Services, you affirm that you have read, understood, and agree to these Terms.
